▪ Cancellation & Refund Policy}All mentions of “YesterdaysDog” serve to represent the artist. All mentions of “the client” serve to represent you, the client.General Terms1. ^{YesterdaysDog has the right to refuse or deny any commission at any time for any reason. This includes after payment has been received and/or work has started. Please see Cancellation and Refund Policy for more information.}


2. ^{The client must be 18 (eighteen) years of age or older. If proof of age is requested and cannot be supplied, I reserve the right to deny the commission.}


3. ^{The client is not allowed to publicly display or upload copies of the work that lack YesterdaysDog’s signature. This includes but is not limited to real world public displays, online uploads, and social media profiles.}


4. ^{Prices are subject to change based on a variety of factors, including but not limited to demand, hours worked, and cost of living. Price changes will be discussed with client prior to change.}


5. ^{Client agrees to provide YesterdaysDog with clear and coherent reference image of any characters requested to be drawn. Clear and coherent reference image is defined as a character reference sheet showcasing one or more angles of the character with clear presentation of any and all colors and markings. Reference must be free of shading OR have flat color swatches provided for accurate color. If client requests character to be drawn in a pose that the reference image does not show markings of (I.E. reference image only shows front of character, client wants character’s back shown in finished work), the client agrees to provide a reference or detailed description of markings. In the event that the client does not have a reference and provides instead a detailed description, client agrees to 1 (one) edit of markings drawn. Further edits will be subject to charge as seen necessary.}

Payment1. ^{All advertised prices represent price in USD (United States Dollar.)}


2. ^{All payment must be received via Pay-Pal.}


3. ^{Payment via Cash-App will be allowed in the event of purchasing pre-made artwork valued under $100.00 (One Hundred Dollars USD), such as, but not limited to, pre-made character designs.}


4. ^{Payment can be paid either 100% upfront OR split 50% upfront and 50% after sketch approval.}


5. ^{Payment plans approved on case by case basis.}


6. ^{Do not, under any circumstances, send YesterdaysDog any money until commission slot has been discussed and confirmed.}

Process & Delivery1. ^{Completion time subject to a variety of factors including but not limited to health, work schedule, queue, and complexity of piece.}


2. ^{Client will receive full resolution and low resolution versions of completed work. There is no physical product unless stated otherwise. Delivery of completed work will be via E-MAIL unless client requests otherwise.}


3. ^{YesterdaysDog guarantees the storage of client files on personal storage devices for up to 1 (one) year past completion. In the event of loss of files, client is encouraged to reach out to YesterdaysDog to request copies of files. If more than 1 (one) year has passed from the date of completion, there is no guarantee that the files will be able to be delivered to client but if YesterdaysDog has the files, they will be sent to client.}

Revisions1. ^{Client is given 3 (three) free of charge revisions per commissioned piece included in the price.}


2. ^{Beyond the 3 (three) free revisions, further revisions will be subject to extra charge as seen necessary. If revision is seen as minor, or a mistake at the hand of YesterdaysDog, the revision will be free of charge. Mistakes include but are not limited to missed details of character design, and missed details included in original client request.}


3. ^{Changes of aspects of the work that were previously approved by the client will be subject to a fee depending on complexity of said change.}


4. ^{Changes that occur based on unclear reference images will be subject to charge.}

Copyright & UsageI, YesterdaysDog, the working artist:1. ^{Reserve the right to cancel and refund the order at any time for any reason.}


2. ^{Retain all copyrights over the commissioned work.}


3. ^{Will not claim the intellectual property (IP) of the commissioned artwork. (I.E. Subjects and characters drawn still belong to their rightful owners.)}


4. ^{Will NOT profit further from the commissioned artwork unless the client breaks any of the terms as presented in this document, OR unless otherwise discussed with client.}


5. ^{Reserve the right to post or publish the commissioned artwork online, on my portfolio, and/or in publications including but not limited to art books.}

You, the client:1. ^{May upload the commissioned artwork on any website and social platforms.}


2. ^{May display the commissioned artwork in your home, on your belongings, and/or on your person.}


3. ^{May NOT make profits from the commissioned artwork unless previously discussed with YesterdaysDog. This includes but is not limited to reselling, redistribution, uploading to POD services, selling prints, stickers, etc. Fees and royalties will be accrued on case by case basis.}


4. ^{May NOT alter the commissioned artwork without the prior consent from YesterdaysDog.}


5. ^{May be allowed to sell the artwork if it is being sold with the character design of the character featured in the artwork. New owner of character will be subject to the same terms of services displayed here.}


6. ^{Retain the rights to the intellectual property. (IP)}


7. ^{May NOT use the commissioned artwork for commercial purposes without prior discussion with YesterdaysDog. Fees and royalties will be accrued.}

The following is considered copyright infringement.1. ^{Reproducing / using the copyrighted artwork commercially as a means to profit in any way, form, or fashion without prior discussion, fees, and royalties.}


2. ^{Claiming the artwork as your own. Defined by YesterdaysDog as claiming to have been the artist to create the work.}


3. ^{Altering the artwork without the consent of YesterdaysDog.}


4. ^{In some cases, commercial rights to the work may be purchased.}

Cancellation & Refund Policy1. ^{If client requests refund once work has started on the commissioned artwork, YesterdaysDog is entitled to keep a percentage of the commission fee based on how much work has been completed. Percentage kept will never amount to more than 60% of work. This is considered a “kill fee” and exists to compensate YesterdaysDog for hours already worked.}


2. ^{If client requests refund once work is near completion, a refund will be denied.}


3. ^{If client requests refund once work has been started, YesterdaysDog will supply client with the unfinished product and issue partial refund.}


4. ^{If client requests refund when no work has started, client will receive full refund.}


5. ^{If client paid via PayPal DO NOT request a PayPal charge-back OR file a PayPal claim. The funds will be transferred back to client by YesterdaysDog in timely manner.}


6. ^{If PayPal charge-back or claim is filed at any point when client was not allowed to request refund from YesterdaysDog, did not try to request refund from YesterdaysDog, or did not attempt to communicate with YesterdaysDog, client will lose all aforementioned rights to the commissioned work and YesterdaysDog will receive the full rights to profit from the commissioned work in any way, form, or fashion. Client will be declined PayPal charge-back or claim and YesterdaysDog will supply PayPal with necessary evidence. Evidence includes but is not limited to social media conversations, social media posts, E-Mail conversations, other forms of correspondence, terms of service, and evidence of completed or partially completed work. Client will be permanently blacklisted from commissioning YesterdaysDog. Repeat offenders will be permanently and publicly blacklisted. Legal action will be taken as seen necessary for extreme cases.}

By commissioning YesterdaysDog for paid work, client agrees to all terms and conditions outlined in this document.
